THE STATE HISTORIC PRESERVATION OFFICER

Each state and territory, and each of a few other entities related to the United States,11 has a State Historic Preservation Officer (SHPO). The SHPO is a state government employee, responsible for administering the national historic preservation program in his or her state. That means nominating places to the National Register, participating in section 106 review on behalf of the state, helping local governments set up preservation programs, and performing a variety of related functions called for by NHPA. Critically for purposes of EIA and CRM, the SHPO is supposed to advise and assist federal agencies in carrying out their section 106 work. In doing so, according to the section 106 regulations, the SHPO “reflects the interests of the State and its citizens in the preservation of their cultural heritage.”12

So the SHPO is the one to turn to if you have a problem with the way your cultural heritage is being treated, right? Wrong.

While some SHPOs are interested in cultural heritage, most concern themselves only with historic properties. As with the National Register, if it’s an old building or an archaeological site you’re worried about, the SHPO will talk with you; if it’s your ranching lifestyle or a fish run or your ability to carry out a religious ritual, you’re likely out of luck.

And SHPOs can interpret the notion of “historic properties” very narrowly. For instance, consider the case of “Between the Rivers.”
